Introduction and Definition of Terms

These Terms of Use ("Terms") govern access to and use of the services ("Services") located at aswellian.org (the "Site"). Any information, text, graphics, or other materials appearing on the Site (collectively referred to as "Content"), is the property of Aswellian Research ("Operator") and it's licensors.

Any legal person ("Person") or computer system operated by a Person or other legal entity ("Bot") which accesses the Services and Content at this Site (collectively referred to as a "User"), requires acceptance of and compliance with these Terms. Therefore, any User (Person or Bot) accessing Content and Services on this Site implicitly agrees to be bound by these Terms. 

1. Limitation of Liability & Indemnification

1.1  Responsibility

Under no cicumstances shall the Operator of this Site, or any of it's licensors, be liable for any damage or loss as a direct or indirect consequence of a User accessing Content on this Site.

All Services and Content are made available for informational purposes only. The opinions and views expressed on this Site do not constitute professional advice, and the Operator nor it's licensors shall be responsible for a User's response to the Content provided.

1.2  External Services

There are links to other websites and internet resources for User convenience, and such links do not imply endorcement of those websites. In addition, the Operator has no responsibility or liability for any software or information found on any other website.

1.3  User Content

The Operator is not responsible for the content or accuracy of any information posted by a User, and shall not be responsible for any decisions made based on such information.

2. Copyrights and Restrictions on Use

2.1  Site Content

The User agrees that the Services offered by this Site, including Content in the form of photos and graphics, audio and video clips, articles and editorial content, contain intellectual property that is owned by the Operator and it's licensors, and is protected by intellectual property laws.

The Operator of this Site has licensed this Content, which is available to be viewed by any User of the Site. All Operator provided Content is protected by US Copyright Law, and/or International Treaties (member countries), and remains property of the licensors.

The User acknowledges that they will abide by all copyright notices or restrictions contained in or attached to any Content.

Any commercial use of copyrighted Content in any form, without written permission, is not permitted. Contact the Site Operator to request permission to use any copyrighted Content.

2.2  User provided Content

All Content uploaded by a User remains the intellectual property of the creator, the Operator does not claim ownership of User provided Content.

If any Content available through the Services of this Site infringes upon any copyright you own or control, please contact the Site Operator to request removal.

3. User Agreement

3.1  Registration

The User will need to register to access some features, such as receiving a newsletter, participating in surveys and making comments. The User is responsible for keeping their username and password safe, and it is recommended to use a unique password not only for this site, but for all sites.

All information provided when registering may be changed or deleted by the User at anytime.

3.2  Rules of Conduct

The User hereby agrees they will not us this Site or Services:

    • To exploit, harm or inhibit use of other Users or the Services in general.
    • To impersonate or attempt to impersonate other Users.

3.3  Comments and Surveys

Comments and Surveys are enabled for any registered User, to allow both constructive feedback and commentary on the Content presented at this Site. However, by using the commenting system the User agrees to the following:

    • If the Operator of the Site or it's moderators decide that the Comments system does not add value to the Services and Content provided, Comments may be disabled.

4. Account Termination and Suspension

4.1  Termination by Users

A User may stop using the Site at any time, and information associated with registered users may be deleted by logging in and visiting the User account page.

4.2  Termination or Suspension by Site Operator

The Operator reserves the right to suspend or terminate a User account and prohibit access to Services and/or the Site without notice if (a) the Operator determines the Terms of this Agreement have been violated, or (b) the Operator determines suspension or termination of a User will improve the overall User experience of the Services offered by the Site.

5. Governing Law and Juristiction

These Terms are governed by the laws of the State of Montana, USA. Any legal disputes related to violation of these Terms, or any other matter involving the Operator of this Site, will occur under the juristiction of the State and Federal Courts of Montana.
